Keng AI Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Keng AI website and subscribing to our AI Receptionist services. By accessing or using the Service, you agree to be bound by these Terms.

1. Agreement to Terms

These Terms govern your access to and use of the Keng AI website and the AI Receptionist and related job management services ("Service") provided by Keng AI ("Company," "We," "Us," or "Our"), located at 19 Sycamore Avenue, Daventry, NN11 3ST.

2. The Service

Keng AI provides an AI-powered receptionist and job management system for garages. The Service includes automated appointment booking, customer communication (SMS/Email), data capture (Name, Phone Number, Car Details, Job Brief), calendar synchronisation, and, depending on the plan, automated job tracking/pipeline management.

2.1. AI Functionality and Limitations

You acknowledge and agree that the Service relies on artificial intelligence. While We strive for professional and accurate communication, the AI may occasionally fail to understand complex or unusual requests.

Knowledge Base: The AI's ability to answer customer FAQs is limited to the information you provide (website URL to crawl or text document). Keng AI is not responsible for miscommunication resulting from incomplete, outdated, or inaccurate information provided by the user.

Call Handling: You are responsible for configuring your call forwarding settings (Forward All, Missed Calls Only, When Busy). Keng AI is not liable for missed calls due to misconfigured call forwarding.

Data Sync: While we aim for flawless data synchronization with your CRM/Calendar, we cannot guarantee the stability or compatibility of third-party software.

3. Subscription, Fees, and Payments

3.1. Monthly Subscription and Setup Fees

The Service is provided on a monthly subscription basis. By subscribing, you agree to pay:

A non-refundable, one-time Setup Fee upon initial enrollment, which covers custom AI voice scripting, knowledge base training, and calendar/integration setup. The Setup Fee varies by tier (e.g., £249 for The Essentials, £299 for The Tracker/Enterprise).

A recurring Monthly Subscription Fee specific to your chosen tier (The Essentials, The Tracker, or The Enterprise).

3.2. Billing and Automatic Renewal

Initial Payment: The Setup Fee and the first month’s Subscription Fee are due upon signing up for the Service.

Renewal: The monthly Subscription Fee will be automatically charged in advance each month on your billing date.

Pricing Changes: We reserve the right to modify subscription fees upon thirty (30) days' prior notice. Your continued use of the Service after the price change constitutes your agreement to pay the new amount.

3.3. Call Minutes and Overage Charges

Each subscription tier includes a specific allowance of monthly call minutes (e.g., 300, 600, or 1,000 minutes).

Overage: If your usage exceeds the included minutes in any billing cycle, you will automatically be charged an overage fee per minute at the rate specified for your plan (e.g., 35p, 30p, or 25p per minute). These charges will be added to your next monthly bill.

Rollover: Unused minutes do not roll over to the next month.

3.4. Payment Methods

You must provide a current, valid, accepted method of payment. You authorise Us to charge all fees and charges to your chosen Payment Method.

4. Cancellation, Termination, and Refund Policy

4.1. Cancellation

You may upgrade, downgrade, or cancel your monthly subscription plan at any time by providing Us with 30 days' written notice to [email protected].

4.2. Termination by Keng AI

We may terminate or suspend your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

4.3. Refunds

Setup Fees are non-refundable once the setup process (AI voice scripting, training, and integration) has commenced.

Monthly Subscription Fees are non-refundable. If you cancel, your Service will remain active until the end of the 30-day notice period, and no partial refunds will be provided for unused time or minutes.

5. User Responsibilities

You agree to:

Provide accurate information required for the AI Knowledge Base setup and calendar integration.

Comply with all applicable laws and regulations concerning telephone communications, marketing (including the use of captured contact data), and data protection (UK GDPR).

Maintain the confidentiality of your account login information and be solely responsible for all activities that occur under your account.

6. Intellectual Property

All intellectual property rights, including the AI platform, automation systems, software, voice scripts, and data synchronisation tools, are the exclusive property of Keng AI. Your use of the Service does not grant you any ownership rights to the Service or the underlying technology. Unauthorized use or reproduction is strictly prohibited.

7. Limitation of Liability

To the maximum extent permitted by law, Keng AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service.

Any conduct or content of any third party on the Service.

Any errors or miscommunications made by the AI Receptionist.

Any missed bookings or business opportunities.

In no event shall the total liability of Keng AI for any and all claims related to these Terms exceed the amount you paid to Keng AI in the six (6) months immediately preceding the event giving rise to the claim.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom (England and Wales), without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on this page and/or via email prior to the change becoming effective. By continuing to access or use Our Service after those revisions become effective, you agree to be bound by the revised terms.
